AI today is growing multi‑fold and we still do not know all the advantages or pitfalls associated with it which are yet to be completely discovered. This is why it is of utmost importance to have a two‑layered protection model; one, technological regulators; and two, laws to control AI actions as well as for accountability of errors. India has the right talent and technological resources. With a powerful legal directive, the country can set many milestones with a strong command over Artificial Intelligence.”

Initiative by Supreme Court
In April 2021, The Supreme Court launched the Supreme Court Portal for Assistance in Court Efficiency AI portal for referring the case.
“It is intended to do what a human mind can do, but much more efficiently, methodically and systematically,” said CJI S.A. Bobde while introducing the Supreme Court’s AI tool SUPACE. Emphasizing its assistive nature, he clarified, “We will not allow it to spill over to decision-making.” He described the system as “a perfect blend of human intelligence and machine learning. A hybrid one.” On the limits of AI in the justice system, he warned, “If AI decides a case, it would be disastrous to the judiciary,” firmly stating that “a machine ought not to dictate decisions.” Comparing its function to instinctive mental processes, he said, “AI is to intellect what muscle memory is to our mind.” He assured that “the software would fully retain autonomy and discretion of the judge at a much, much faster pace because of the readiness with which the information is made available by the AI.” However, he drew a clear ethical line: “Artificial Intelligence can supplement but not supplant a judge; it cannot be allowed to determine [the] outcome of a case.” Reiterating the human element in justice, he noted, “There is a lot of emotional basis to a judicial decision, which AI cannot reach,” and concluded, “These assistive tools must give us all the information necessary but we will not allow it to tell us what to decide.”
